Middlefield Recall petition sent to Governor's desk

BOSTONState Senator Benjamin B. Downing (D- Pittsfield) and State Representative Stephen Kulik (D- Worthington) are pleased to announce that H. 3495, An Act providing for recall elections in the town of Middlefield has been enacted by both the House of Representatives and Senate and is now on the Governor’s desk.
This home rule petition, sponsored on behalf of the Town by Kulik and Downing, was approved by Middlefield residents at Town Meeting on May 4th. It establishes a process by which residents can request and garner local support to recall elected municipal officials. The legislation mandates that a recall affidavit signed by at least 50 registered voters may be filed with the Middlefield Town Clerk. After the grounds for recall are established, the recall petition must then garner the signatures of at least 25% of the registered voters of the Town. If all of the requirements are met, and the official does not choose to resign, a recall election will be scheduled within 70 days.
Under this proposal, the officer in question may file an argument against the recall, and further, no officer can be recalled within six months of taking office or in the last six months of his or her term. Lastly, no official who has been recalled can be appointed to a local position within one year of the recall.
A similar Middlefield home rule petition received the preliminary approval of the Massachusetts Senate in 2010 but did not advance in the House of Representatives. Governor Patrick has ten days to review and act on H. 3495.
